How Much Is My Claim Worth?
As we have explained silica dust exposure can cause a number of different medical problems and how much you may receive in compensation is of course dependant upon which of those conditions you may have developed and the severity of the same.
We will give you some examples of how much you could get for common silica dust associated illnesses but before doing so it is important that we highlight the fact that the figures quoted below are for general damages only. In addition to general damages, essentially a payment for actually developing the condition in question, you may also be entitled to what is known as special damages. In some cases, especially the more severe medical conditions, it is not uncommon at all for the special damages award to be significantly higher than that for general damages. Special damages need to be calculated on an individual case by case basis and include matters such as:
- Loss of earnings
- Loss of pension
- Care costs
In terms of general damages it should be noted that in the UK compensation awards are not as generous as perhaps they could be or should be. Typical awards can be in the region of:-
Silicosis – Up to £119,210
Asthma – Up to £34,280
Other breathing problems that require the use of an inhaler – Up to £43,710
Short term breathing problems that:
Recover completely within two years – Up to £16,580
Recover completely within a few months – Up to £10,040
In addition to the above you may be able to claim even if you had chest or other health problems before you were exposed to diesel fumes, we call this an exacerbation or an acceleration claim.
The above figures are intended to be for guidance only, each of us is different and therefore each case is different.
